Preamble

The site is the property of company EARL Château Tourril in its totality, as well as the whole of the related rights thereof. Any reproduction, integral or partial, are systematically subject to the authorization of the owners. However, the connections of the hypertexts type to the site are authorized without specific requests.

1. Acceptance of the conditions

The customer admits having taken acknowledged, at the time of the placement of the order, of the particular conditions of sale stated on this screen and expressly states to accept them without reserve.

The present general terms of sale govern the contractual relations between EARL Château Tourril and its customers, the two parties accepting without reserve. These general terms of sale will prevail on all other conditions appearing in any other document, except preliminary, express and written exemption.

2. Products

The photographs illustrating the products do not enter the contractual field. If errors were introduced thereto, in no case the responsibility for EARL Château Tourril could not be liable. The majority of the proffered products to its customers by EARL Château Tourril are available in our warehouse.

3. Orders

The system of automatic recording is regarded as being proof of nature, of contents and of the date of the order. EARL Château Tourril confirms the acceptance of the order to the customer with the address e-mail that the client has provided. The sale will be concluded only upon confirmation of the order. EARL Château Tourril reserves the right to cancel or refuse any order of a customer with whom would exist a litigation relating to the non- payment of a previous order. The information stated by the purchaser, at the time of the reception of the order engages that: in the event of error in the wording of the coordinates of the recipient, EARL Château Tourril is not held responsible for the circumstance in which we are unable to deliver the product. The products are sold, in lots of 6 75cl bottles and per carton for the 1,50L Magnum which is sold individually.

4. Delivery

After confirmation of order, EARL Château Tourril commits to deliver to their carrier all the products ordered by the purchaser within a maximum of 8 working days. These carriers under contract with EARL Château Tourril to deliver the order to the address of the purchaser provided by EARL Château Tourril. Cash-on-deliver orders (CODs), the customer has to provide payment to the carrier or his representative the totality of the sum indicated at the time of the confirmation of order.

For Deliveries outside of Metropolitan France, the customer is responsible for all taxes incurred due to the importation of the product, customs duties, taxes, value added taxes, and all other taxes due under the terms of the laws of the country of destination. All the orders placed with EARL Château Tourril are intended for the personal us of the customers or the product consignees and prohibit any partial or total resale of all EARL Château Tourril products.

All deliveries will be carried out by GEODIS CALBERSON. All deliveries are carried out Monday thru Friday except bank holidays. Reception of the deliveries is to the customer of record, and in the case of absence with their registered factor. Any delays in delivery are not the responsibility of EARL Château Torril and in no way accepts claims for damages due to late deliveries.

All deliveries within the EEC are by GEODIS CALBERSON , deliveries outside the EEC are affected by international postal services or Chronopost. It is the customer’s responsibility to insure that all deliveries made by these carriers arrive in good order and undamaged.

In the event of apparent defects, the purchaser profits from the right to repossess under the conditions envisaged in this document.

Are regarded as emergency discharging the salesman from his obligation to deliver, the war, the riot, the fire, the strikes, the accidents and impossibility of being supplied. The goods always travel to the risks and dangers of the recipient. Always check your parcel on arrival. You have a 48 hours deadline to make possible reserves near the carrier in the event of lack or degradation.

For reasons of availability, an order can be delivered in several times to the customer. The customer does not regulate whereas only one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the dependant expenses of delivery.

5. Cancellation :

The customer has 7 days from the receipt of the product to cancel the order and request a refund. All returns must be effected by the customer at the customer’s expense. All returns must be effected by registered post to the following address :

In the event of cancellation and return, all monies owed will be refunded by EARL CHÂTEAU TOURRIL in its entirety minus shipping expenses and deductions of any products used.

6. Prices

The prices are expressed in Euros.

The prices indicated on inventory do not include transport.

The prices indicated in the confirmation of order are the final prices, are inclusive of all taxes, including the VAT for France and the E.E.C. inclusive of the products posting and packaging.

7. Payment

The price invoiced is the price indicated on the confirmation of the order by EARL CHÂTEAU TOURRIL.

Payment of the order is in cash on placement of the order.

Payments are carried out by bank card. In order to ensure the safety of payments EARL CHÂTEAU TOURRIL utilizes a secure payment system:

- PAYPAL (payments accepted by CB or PayPal)

The service of PAYPAL integrates safety standard SSL. The confidential data (N° of bank card with 16 digits, expiration date) are transmitted encrypted (coded). When the customer validates his order, the claim for payment is transmitted in real time on the secure service of PAYPAL.

The order validated by the customer will be considered effective only when the payment is credited to our account in the event of refusal of the centers, the order will be automatically cancelled and the customer warned by e-mail.

The customer can also pay by check or wire transfer of funds.

In the event of payment by check; all checks must be made on a metropolitan French or monaquasque bank and made out to the order of EARL CHÂTEAU TOURRIL. The order validated by the customer will be considered effective only when EARL CHATEAU TOURRIL’s account is credited with the check or the transfer; upon receipt of funds an email confirmation will then sent to the customer.

In addition, EARL CHÂTEAU TOURRIL reserves the right to refuse any order of any customer with who would exist a conflict with any of the above.

8. Liabilities

This contract is subject to the French law. EARL CHÂTEAU TOURRIL cannot be held responsible for damages of any nature, material or immaterial or body, which could result from the misuse of the marketed products as well as the possible modifications of the products resulting from the manufacturers. The responsibility for EARL CHÂTEAU TOURRIL will be, in any event, limited to the amount of the order and cannot be held liable for simple errors or omissions existing despite the best efforts and precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the purchaser has the possibility, before any legal action, to seek a friendly solution in with the assistance of a professional association , of a consumers' association or any other council of their choice. The search for the friendly solution does not stop the “short time” of the legal guarantee, nor contractual warranty period. The provisions of this contract relating to the contractual guarantee between buyer and seller requires that purchaser honors their financial liabilities towards the seller.

All claims or disputes will be processed in good faith. In the event of dispute, the customer should immediately contact EARL CHÂTEAU TOURRIL to obtain an amicable solution to their concern.

Failing this, the Court of Narbonne (11000 France) is the only recognized and qualified venue, whatsoever the place delivery and the method of payment.
